General conditions of Sale

1. Premises
1.1. These general conditions of sale apply to purchases made through the website www.molinolatina.com by Consumers and / or Professional Buyers, defined and identified as follows;
1.2. Depending on the buyer - consumer or professional buyer - who finalizes the contract, different rules and standards will apply, according to the relevant legislation.

2. Definitions
2.1. The Seller is Molino Latina srl Unipersonale with registered office in Corso Umberto I, 23 - Giarratana (RG), VAT number 01260280886 - which acts in the exercise of its business and commercial activity and promotes the sale of its products through the mechanism of contracts remotely, through the www.molinolatina.com platform in compliance with these General Online Sales Conditions;
2.2. The professional Buyer is the freelance professional or legal person who, by means of an appointed and authorized natural person (legal representative, employee, collaborator), interacts with the e-commerce platform and concludes an online sales contract, in the exercise of their business and commercial activity;
2.3. The Consumer is the natural person who acts for personal and non-professional purposes, unrelated to any entrepreneurial, commercial, craft or professional activity carried out, as defined by the Consumer Code.
2.4. By User we mean the visitor of the platform who interacts with the functions of the site: the notion includes both the Consumer and the Professional Buyer;
2.5. The Consumer Code means the Legislative Decree 6 September 2005, n. 206 (Consumer Code) and subsequent amendments and additions;
2.6. The Contract is the purchase and sale contract concerning the movable goods present on the e-commerce portal which is concluded between the Seller and the Professional Buyer and / or the Consumer, in the context of a sales system through telematic tools, organized by the Seller. ;
2.7. By Parties we mean the Seller and the Consumer or the Seller and the Professional Buyer;
2.8. By Portal or Platform or Website we mean the website www.molinolatina.com, managed by the Seller, through which the online purchase contract is finalized.

3. General Provisions
3.1. These General Conditions of Online Sale regulate the commercial relations between the Seller and the Consumer and / or the Professional Buyer and constitute an integral and substantial part of the contract for the sale of movable goods that will be concluded;
3.2. The Consumer and / or the Professional Buyer is aware that the General Conditions of Sale that are published on this Portal may vary: for this reason each purchase is subject to and governed exclusively by the General Conditions of Sale in force on the date of completion of the contract;
3.3. The Parties, in compliance with the mandatory provisions of law, agree that if some provisions of these general conditions of sale are declared null or void, this fact will not affect the validity and effectiveness of the other provisions which will remain fully valid and effective. .

4. Object of the online sales contract
4.1. The subject of the online sales contract is any tangible movable property present on the www.molinolatina.com Portal that the Seller offers for sale and that the Consumer or Professional Buyer intends to purchase, through the interaction with the aforementioned Platform, i.e. remotely. through telematic tools;
4.2. This online sales contract governs the purchase conditions between the Seller and the Consumer or the Professional Buyer based in Italy and which require delivery in the Italian territory;
4.3. The goods that can be purchased through the procedure in question are only those that can be viewed on the pages of the Portal.

5. Acceptance of the conditions

The sales contract stipulated between Molino Latina Srl Unipersonale and the Customer, through the web portal "www.molinolatina.com" must be considered concluded with the acceptance, even if only partial, of the order by Molino Latina Srl Unipersonale, which reserves the right to accept the order itself. Acceptance is always explicit, and is communicated to the Customer at the e-mail address indicated at the time of the order. By placing an order in the manner provided, the Customer must declare that he has read all the information provided during the purchase procedure and that he fully accepts the general and payment conditions described below.
5.2. If the Customer is a final consumer (natural person for purposes not related to his professional activity), once the purchase has been concluded through the site https://www.molinolatina.com, he will have to print or save an electronic copy and, in any case keep these general conditions of sale, in compliance with the provisions of the current legislation on distance selling.
5.3. Any right of the Customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order is expressly excluded.

6. How to purchase
6.1. The Customer can only purchase the products present in the electronic catalog of Molino Latina Srl Unipersonale at the time of placing the order and viewable at the web address https://www.molinolatina.com, as described in the relevant information sheets. Molino Latina Srl, reserves the right to modify the information on the properties of the products to adapt them to those provided by the manufacturers, without any prior notice. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics, and may differ in color, size, accessory products shown in the figure. Molino Latina Srl assumes no responsibility for any errors present in the product sheets of the articles marketed, which must therefore be understood as purely for commercial and marketing purposes.
6.2. The order is binding for the customer and its correct receipt is confirmed by Molino Latina Srl by means of an e-mail reply, sent to the e-mail address supplied by the customer. This confirmation message will contain the date and time of receipt of the order and a 'Customer Order Number', to be used in any further communication with Molino Latina Srl.
6.3. In case of non-acceptance of the order, Molino Latina Srl undertakes to promptly notify the Customer.
6.4. All prices on the site are to be understood as retail prices and, therefore, inclusive of VAT. Molino Latina reserves the right to change prices at any time, without prior notice. The changes made to the offers and the relative prices are effective from the date and time of publication on the website https://www.molinolatina.com.
6.5. Molino Latina Srl reserves the right in any case to accept or refuse an order, even if valid, at its sole discretion.
6.6. Molino Latina reserves the right to issue an invoice only upon express request indicated in the purchase procedure.

7. Methods of payment
7.1. PayPal.
With PayPal payment, the amount is charged directly to the credit card (Visa, Visa Electron, Mastercard) or prepaid (Poste-Pay) assigned.
PayPal protects the buyer's information, therefore at no time during the purchase procedure Molino Latina is able to know the information relating to the buyer's credit card, as they are typed directly on the website of the bank that manages the transaction with very high security systems; since there is no data transmission, there is no possibility that these data are intercepted. No computer archive of Molino Latina contains the customer's credit card data. In no case Molino Latina can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment for products purchased on https://www.molinolatina.com. A confirmation e-mail from PayPal will be sent to each transaction performed with this method. The amount of the order is debited from the PayPal account at the time of the order. In the event of cancellation, the amount will be refunded to the customer's PayPal account. Payments are accepted only from registered users on the PayPal site.
The order cannot in any case be canceled by the Customer as the goods, if available, are immediately prepared for shipment to the customer.
In some cases Molino Latina reserves the right to request additional information from the Customer or to send copies of documents proving ownership of the Card used. In the absence of the required documentation, Molino Latina reserves the right not to accept the order.

8. Methods and terms of delivery of the goods
8.1. Molino Latina Srl can only accept orders for delivery in the territory of the Italian state.
8.2. Molino Latina Srl will deliver the products purchased by the User in the manner indicated in the "cart contents" window.
8.3. Molino Latina Srl will ship the goods by Express Courier within 5 working days (except for products not available in stock) starting from the moment in which the online sales contract is finalized. The shipping terms are to be intended as indicative and not mandatory: any delays in the delivery of the goods do not entitle the Consumer or the Professional Buyer to terminate the concluded online sales contract.
8.4. During shipment, the goods travel at the risk and peril of the Consumer or Professional Buyer, therefore no responsibility can be charged to Molino Latina Srl for any damage caused to the goods during transport or in the event of theft of the goods already delivered to the Carrier, unless ascertained. responsibility of the latter.

The Customer relieves Molino Latina Srl from any liability deriving from the issue of incorrect tax documents due to errors relating to the data provided by the Customer, since the Customer himself is solely responsible for the correct insertion. No change in the invoice will be possible after its issue.
8.8. At the time of delivery of the goods, the Customer is required to check that the number of packages delivered corresponds to what is indicated on the invoice, that the packaging is intact, not damaged, nor wet or, in any case, altered. Any anomalies must be immediately reported to the courier making the delivery and promptly reported to the email address info@molinolatina.com. Any damage or hidden anomalies must be communicated in the same way.

9. Privacy
9.1. The personal data requested when placing the order are collected by Molino Latina Srl and processed on computer media, in order to satisfy the obligations arising from the contract concluded with the Customer and will in no case or for any reason be transferred to third parties. Molino Latina guarantees its customers compliance with the legislation on the processing of personal data, governed by the privacy code referred to in Legislative Decree. 196 of 30.06.03, and subsequent amendments.
9.2. The data controller is MOLINO LATINA SRL, in the person of the pro-tempore legal representative. Attached to this contract is the Information pursuant to Article 13 of Legislative Decree 196 of 2003, which constitutes an integral and substantial part thereof.
9.3. The customer, at any time, has the right to withdraw consent to the processing of personal data with written communication to be sent to the registered office of Molino Latina Srl.
9.4. The customer, who declares to have received the information pursuant to art. 13 on the rights due to the same, pursuant to art. 7 of the Legislative Decree. n. 196/2003, has the right to access their data in the manner provided therein.
9.5. Marketing communications will be sent only with the explicit consent of the Customer issued together with the authorization for processing and sending the online registration form.

10. Jurisdiction and Applicable Law
10.1 The sales contract between the customer and Molino Latina Srl is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Forum of Ragusa.

11.1. The conditions contained in this document may be modified by Molino Latina without prior notice and will be valid from the date of publication on the website www.molinolatina.com Modica, 19 June 2019.
